Ilmar Molder actively freelances as a personal Social Media Manager specializing in the growth of Instagram accounts. In this disclaimer the term ‘I’ or ‘me’ refers to Ilmar Molder, the Social Media Manager and the term ‘You’ or ‘your’ refers to you, the Social Media Client, or the reader/viewer to whom I will be managing the account for, the one who sends payment for the service, and/or the one who is in communication with I/me the Social Media Manager. This disclaimer including, but not limited to the information within waives of legal responsibility, and protects me in the event of legal action against me for wrongful use of your Instagram Account. Numerous pre-cautions have been set to prevent wrongful use of your Instagram Account, and some of these wrongful uses can be found below. This Disclaimer does not waive potential Refunds if you are unsatisfied with the service. For information on Refunds please view that section below.

1. Account Control
You, the client allow me full access to your Instagram account to use every feature that is a part of the Social Media app/website/platform Instagram without providing express notice each time your account is accessed. I do not need to notify you or give you a visual proof of when I am accessing your account or what is being done with your account while I have access to it. This is necessary so that I can do activities associated with managing your account including, but not limited to, sending messages, following and un-following users, liking photos, etc. This also allows me to do my work on your account without having to notify you/send you messages/or get verification from you each time I log-in, or perform any functions with your account.

I, your Social Media Manager, will not post any photos or videos to your Instagram Wall, unless it is confirmed by you, the client. I do not alter, delete, or edit your photos or videos in any way, unless it is confirmed by you.

a. Following
Part of a strategy used by me to get a high converting and engaging following to your Instagram Account may involve utilizing Instagram’s follow feature to follow various user accounts across the Instagram platform. These users will be unfollowed later on through the course of this service.
You will never exceed following 7500 users on Instagram while using my service. In most cases, you will not exceed following 2000-3000 users throughout my service.

aa. Liability
I am not responsible for anything that users that you are following, or users that I follow while having access to your account, post in Instagram. Posts include, but are not limited to, photos, videos, comments, captions, hashtags, usernames, tags, and/or any other feature that that user has while using Instagram. This means, that if I follow a user on Instagram using your account, I am not responsible if that user posts any of the following, and more: inappropriate posts of any kind (including, but not limited to: bad words, swears, 18+ content, NSFW content, or anything related), hate speech, illegal content, harassment,etc.
Numerous efforts have been put in place so that the items listed above do not occur. It merely releases me of legal responsibility if any account that contains any of the above mentioned is followed by your account, even if unfollowed later.

If you find you are following an account that contains any of the above content, immediately unfollow the account on Instagram, and alert me of the account, so that I can/may report the account and blacklist it so this does not happen again.

b. Liking Photo/Videos/Posts
Part of a strategy used by me to get a high converting and engaging following to your Instagram Account may involve utilizing Instagram’s like feature on photos/videos/posts of other Instagram users/accounts. You provide me with full access and ability to do this using your account without notice of when these actions are being performed.

bb. Liability
I am not responsible for anything that users that you are liking, or users who’s posts/photos/videos that I Like while having access to your account, post in Instagram. I am not responsible if any of these posts/photos/videos that are liked contain any negative or inappropriate content, including, but not limited to any of the above or below mentioned. Posts include, but are not limited to, photos, videos, comments, captions, hashtags, usernames, tags, and/or any other feature that that user has while using Instagram. This means, that if I Like a user on Instagram’s post/photo/video using your account, I am not responsible if that user posts any of the following, and more: inappropriate posts of any kind (including, but not limited to: bad words, swears, 18+ content, NSFW content, or anything related), hate speech, illegal content, harassment,etc.
Numerous efforts have been put in place so that the items listed above do not occur. It merely releases me of legal responsibility if any account or post/photo/video contains any of the above mentioned and is Liked by your account, even if un-Liked later.

If you find you are Liking a post/photo/video that contains any of the above content, immediately un-follow/un-like the post/photo/video and the account on Instagram, and alert me of the account, so that I can/may report the account and blacklist it so this does not happen again.

c. Direct Messages
Part of a strategy used by me to get a high converting and engaging following to your Instagram Account may involve utilizing Instagram’s Direct Messaging feature to send messages to new followers who begin following your Instagram account. Messages may be sent to people who began following your account, but who un-followed your Instagram account later. The message sent to these users/accounts will be sent, checked, and verified correct to send to these new followers/accounts/users.

cc. Liability
I am not responsible for any messages that you send while using the Direct Messages feature on Instagram. I only send messages to new followers of yours. I am not responsible for any messages sent by me while accessing your account if you have active knowledge of this message being sent and have cleared the message as correct, etc. This means that if you have seen the message I am going to send to new followers, and know it is going to continue to be sent to new followers, but don’t tell me to change, edit, or stop sending the message if you don’t like it, I am not responsible.

I am not responsible for any Direct Messages that other users/accounts send to you, or your account. This message could be the first point of communication between that user/account and you, or your account, replying to a message that I sent while accessing your account, replying to a message that you sent while using your account to that user/account, etc.

I am not responsible if any of these Direct Messages that are sent or received contain any negative or inappropriate content, including, but not limited to any of the above or below mentioned. Direct Messages include, but are not limited to, photos, videos, comments, captions, hashtags, usernames, tags, and/or any other feature/character that that user sends to you while using Instagram. This means, within the Direct Messages feature of Instagram, I am not responsible if any user/account posts or sends you any of the following, and more: inappropriate posts of any kind (including, but not limited to: bad words, swears, 18+ content, NSFW content, or anything related), hate speech, illegal content, harassment, etc.

2. Refunds
Refunds are only given in very extreme cases, and should not be expected during the service. Refunds may be issued by me depending on numerous factors. One way refund amount is calculated depends on the length of time I have been working on your Instagram account. For example, on months you have paid full price for the service. If I have already worked 3 weeks of the month on your account, then I may refund the remaining week at 25% of the service monthly cost if I so choose. This calculation is not accurate for months that have a promotion attached to it including, but not limited to, first month %50 off, months where you have referred a friend to the service and received a percentage off the monthly cost, privately negotiated discounts, etc.

The contents of this Terms of Use or Disclaimer can be changed at any time without notification to you the client, or you, the reader/viewer.
